As of November 2025, EBK Investments, a Utah real-estate development corporation, has been engaged in attempts to evade subdivision restrictions in the northern part of Powell County, Montana, at least in the area near Nevada Reservoir and on Nevada Creek near the towns of Helmville and Ovando.
As of this writing, the Montana Cadastral property information website shows property boundaries of some parcels which have been changed as a result of attempts to avoid subdivision review. Those property boundary changes are currently being contested, and may eventually be litigated. Anyone considering purchasing property being offered by EBK Investments in North Powell County, Montana, should carefully investigate the history of the property lines for the parcel being considered. It would also be wise to check the minutes for the Powell County Planning Board and the Powell County Planning Commission.
The goings on have been sufficiently muddy that approval of the minutes of at least one Powell County Planning Board meeting were delayed until a subsequent meeting, modified, contested, and eventually approved with changes. As of 2026-02-24, the minutes of recent meetings have not been posted to the Powell County Planning Board website.
The North Powell County Preservation Association has been contesting these attempts to evade subdivision review.
